SOME LEGAL ISSUES IN RESOLVING DISPUTES RELATED TO DIGITAL ASSETS USING BLOCKCHAIN TECHNOLOGY

Аннотация:
This article examines the use of blockchain technology in the resolution of disputes related to digital assets and some of its legal issues. Several existing blockchain arbitration processes are analyzed, and finally, the problems the enforceability of a blockchain arbitration award according to the 1958 New York Convention and the problem of whether the form of an arbitration clause in a smart contract satisfy the requirements of Article 2, paragraph 2 (arbitration clause or written rules of the contract) of the Convention) are raised.
