Аннотация:

Xalqaro tijorat arbitraji transchegaraviy nizolarni hal qilishning eng muhim mexanizmi sifatida o'z o'rnini mustahkamlab kelmoqda. Uning moslashuvchanligi, neytralligi va qarorlarining deyarli butun dunyoda tan olinishi va ijro etilishi uni davlat sudlariga nisbatan jozibador muqobilga aylantirdi. XX asrning ikkinchi yarmida xalqaro huquq sohasida "huquqning delokalizatsiyasi" nazariyasi ommalashdi. Unga ko'ra, xalqaro arbitraj milliy huquqiy tizimlardan ajralib, o'zining mustaqil, "millatsiz" huquqiy tartibotini – yangi lex mercatoria (savdo huquqi)ni yaratmoqda.
